Article 1 - Privacy Policy jurisdiction and definitions

This Privacy Policy is governed by the laws of France and will be interpreted in accordance with the French courts. You can access on this page a full English translation for your reading comfort and understanding of the Privacy Policy for the current Ectrl mobile application.

The below listed words defined:

'Mobile application', 'mobile app' or 'app' : the mobile application Ectrl and all its screens/ features.
'Publisher' : IMHOTEP création, the legal or natural person responsible for editing and publishing content on the app.
'User' : the person using the app.

Article 2 - Introduction and role of the current document

This privacy policy informs you of the commitments the app publisher is taking in order to respect your privacy and protect the personal data collected/ processed when using the app.

Should the app require you to register as a user, you agree to provide true information about yourself. Communicating false information is contrary to the Terms and Conditions of Use of the current app.

IMHOTEP création may modify this page at any time, predominantly because of:

The introduction of new services or new technologies
Changes in the legislative and regulatory framework

Article 3 - App data collection

The personal data that can be collected for the use of our application are:

The account / profile creation: Your first and last name and email are registered.
The housing creation: Type of housing, year of housing construction, and mailing address.
The Application use: Your data relating to the connection, navigation, location, data concerning the home (information of energy, type of room…) and other information allowing for the optimization of energy consumption.

Following your navigation on the application, some data may be collected automatically, in particular, your IP address, the connection mode and other technical identifiers or even the URL of the connections, including the date and time.

The data collected and processed by the app are those that you provide voluntarily by filling in the various forms available within the app. For some operations on the contents, you may be required to transmit data about yourself to third-party partners through their own services, specifically when making payments. We will not collect such data; however the collection and processing of this data is made by and governed by conditions of the aforementioned partners. We invite you to check their Terms and Conditions of Use before providing them with your data.

You are informed that the service is likely to implement an automatic tracking process (Cookies or tracking files on the device on which is using the app), which you can prevent by modifying the settings of your device or those of the app, as explained in the Terms and Conditions of Use of this app. You can block this by modifying the relevant settings on your device or application.

According to the data protection act of January 6th, 1978 modified and the European Regulation No. 2016/679/EU 27th of April 2016 (applicable from 25th of May 2018), you benefit from the right to access and require rectification, portability and deletion of your personal data. Article 4 - Collection purposes

Data identified as mandatory on the app forms are necessary for users to properly use the apps services and functionalities, specifically actions on the app contents.

The uses of your personal data are mainly as follows:

Access and use of the application
Verification and authentication of your data;
Management of our commercial relationship;
Provision of personalized services concerning the optimization of your energy consumption, according to the history of your products (set point, temperature, modes ..)
Sending notifications

Data collected automatically by the app will allow for the gathering of analytics data and insights about the app screens, pages, and users behaviour.

Article 5 - Use of collected data

Data we collect about you are processed for the purposes of implementing operations on the app contents.

You are likely to receive e-mails and notifications from the app, including newsletters. You can refuse to receive such e-mails by contacting us at contact@imhotepcreation.com or by using the link provided for this purpose in the newsletters that will be sent to you.

Article 6 - Data security

The user can understand that their data will be disclosed without their consent. During this period, we put in place all means to ensure the confidentiality and security of your personal data, so as to prevent damage, erasure or access by unauthorized third parties.

Article 7 - Data storage time period

Collected data are kept as long as necessary for the purposes mentioned above. Beyond this period, they will be anonymized for statistical purposes.
